Product Purchases

Warranties:  Blue Octopus Scuba Shop (BOSS) does not provide any warranty on products or services including, but not limited to merchantability and fitness for use.  Products sold by BOSS, where warranted by the manufacturer and where such warranty is transferable to the purchaser, are passed to the customer when purchased but must be registered.  The customer is solely responsible for warranty registration of the purchased products.  All warranty claim shipping costs are the responsibility of the customer.  Please retain your receipt for proof of purchase.

Guarantees:  BOSS guarantees to the original purchaser masks, boots, and fins purchased will fit well and be comfortable when used for the purpose for which sold.  We will exchange once, at full value of any of these items, for another such item if you returned within fourteen (14) business days.  All other guarantees, stated or implied, are specifically excluded and void.

Returns & Exchanges

In-stock at time of purchase:  BOSS will refund the total price of items purchased to the original customer only when returned within fourteen (14) business days of date shown on the BOSS invoice/receipt provided the merchandise is unused, in original packaging with all tags attached (as-new condition).  If merchandise is returned within the fourteen (14) business days used, or not in as-new condition, we reserve the right to a store credit less 20% restocking fee.

Special orders:  BOSS will refund the purchase price, less handling costs, on special order merchandise if returned within 14 days unused in as-new condition with all tags and packaging, provided the original manufacturer will accept the return. Note:  BOSS is not responsible for special order merchandise not claimed by the purchaser within thirty (30) business days after arrival of the merchandise at BOSS.

Custom orders:  Products that are custom ordered (size, color, unique application or fit) are not refundable and cannot be exchanged.

Clearance & Final mark-down sales items: Items sold as "Clearance" or "Final Mark-Down" cannot be returned, all sales are final at the time of purchase and sold "as is".                                              

Cash Refunds:  Authorized cash refunds will be distributed to customer by check within thirty (30) business days of refund authorization. 

Services: Instruction and Training:  BOSS course tuition fees are non-refundable.

Rescheduling your training: For publicly offered classes, if you request a change to your training date no later than seven (7) days prior to the start of the class, BOSS will reschedule your attendance to the next scheduled publicly offered date once at no charge.  Should you find it necessary, we will reschedule the class two additional times.  BOSS reserves the right to assess a course change fee up to the total cost of the tuition/per person rescheduled to each change requested. 

Rescheduling private classes may result in the forfeiture of all tuition at the discretion of BOSS.

Rental: Our rental equipment is available only to certified SCUBA divers, and/or student divers under the supervision of a BOSS affiliated SCUBA instructor.  BOSS reserves the right to require demonstrable proof of training and/or experience for end-user of all in-water equipment.  All rental equipment must be guaranteed by a valid major charge/credit card.  The renter authorizes BOSS to charge the fair market value of the equipment if not returned per the rental agreement between BOSS and the end-user.  Rental prices and associated rental periods are available on our Schedule of available rental items.  The Rental Agreement discloses additional terms and conditions to the end-user.

As a SCUBA Diver, you are responsible for verifying that the equipment you rented is in good working order prior to leaving BOSS.  Once rental equipment leaves the store, BOSS is not responsible for expenses associated with missed dives due to equipment malfunction. The end-user(s) is responsible for returning the equipment in good working order. Please note: Rental charges do occur even if the gear is not used. Rental equipment not returned to BOSS in the same condition it was rented in with normal wear allowances, in good working order, on the rental due date will be charged to the renter at retail price for the equipment.

Travel: Travel services are subject to the terms and conditions of each specific BOSS trip you purchase. See contract for details.

Repair: Repair services are subject to the terms and conditions of the BOSS Service Agreement. You may request a copy of the agreement prior to purchasing services. By leaving equipment with BOSS for servicing, you agree to be bound by the terms and conditions of the Service Agreement even if BOSS cannot produce a copy of the agreement with your signature.
